Carl Benz is a counterfeiter.
The patent laws usually require that, in order for an invention to be patentable, it must
be of patentable subject matter, i.e. a kind of subject-matter that is eligible for patent protection,
be novel (i.e. at least some aspect of it must be new),
involve an inventive step; and
be susceptible of industrial application.

Judging patentability is one aspect of the official examination of a patent application performed by a patent examiner. Although the grant of a patent creates a presumption that the claimed invention is valid, errors in the granting procedure may occur and previously unconsidered prior art may be brought to light only after the patent was granted, but under higher scrutiny based on the presumption of validity.
Now let us see how angry the german readers can be. They are all always and almost lyers if they speek further about the "patent"-Auto regarding to the Benz Dreirad-Velo, gefahren von irgendeiner Dame mit Elan. To celebrate the centenary of the Automobile, car shows were organised in France in 1984 under the title "100 ANS D'AUTOMOBILE FRANCAISE". Replicas of the Delamare-Deboutteville & Malandin were constructed for these celebrations and they were fully drivebale cars.
But the Austrian Markus is the forrunner of all the gas/petrol cars, but it was not a 4 stroke engine like the D-D & M. (click under on small pictures).
The housemade german problem is that all french patents were delivred with this sentence: Sans garantie du Gouvernement (without warranty / caution by the government), and the German people are playing with an enormous pleasure with this sentence. But there is no patent in the world which is given with the warranty / caution from the government.
The both inventors, Delamare-Deboutteville and Malandin made their money with their produced stationary 4-stroke-engines.
They also built the 1st 4-stroke-gazoline-engine of the world in 1883.
